Whilst he maitains his innocence, the fact of the matter is that he was there and even if he wasn't the one who swung the bat he did nothing to prevent anyone else from doing it either. He was there and he took part in a serious assault and he walked away from a man with a fractured skull!!I can't believe you are defending him. This was known when we signed him, were people booing him or "making their voice heard" about it through last season? Good signing for us, statement from the club was pretty bizarre though. Agreed although the timing is a little poor really Am a bit surprised that some seen so keen on lynching the guy now when the whole prosecution was well publicised last year but seem really precious about it now. As I posted elsewhere: It should also be remembered that people aren't released on appeal willy-nilly; the law states: If a convicted defendant is sentenced to prison and seeks bail pending an appeal, the judge must also consider the merits of the appeal as well as the defendant’s risk of flight and dangerousness. Essentially, the judge must find by clear and convincing evidence that: 1. The defendant isn't likely to flee 2. The defendant isn't a danger to the community 3. The appeal isn't a delay tactic 4. The appeal raises a substantial question of law or fact likely to result in reversal, an order for a new trial, a reduced sentence or a sentence that doesn't include a prison term Point four is probably the most critical here; I might suggests holding back on the hot tar and pitchforks before the facts are known? It should also be remembered that this was a fight; not an assault on a passer-by.

Findley doesn't know who hit him with a baseball bat, and to my knowledge there wasn't any witnesses to say which one of them did it either, Gallagher is strongly denying it was him but has admitted to throwing punches. Anyway as has already been said this was all known before we signed him last season and with the appeal still to be heard it puts us in much the same situation as last season. What I do know for sure is since he's been at Livi there has been no reason to give him any flak over how he's behaved as a Livi player and that's all that concerns me. I support the team, he's a cracking player for us and isn't a thug on or off the pitch in his time at Livi. He was there and he took part in a serious assault and he walked away from a man with a fractured skull!!I can't believe you are defending him.He has been convicted of the crime and until his appeal is heard he still remains convicted. That is what appeal means. If, as you seem to think, he is out because he is innocent then you are wrong.The Livingston Board are just making a fool of themselves and the fans and losing sponsorship on the way.I thought Mr Ford would know better than to go down this line but maybe it is the person or people who are pulling his strings that are making the decision. He walked away from someone who ended up the loser in a fight. If I remember correctly, he not only denied using a bat he also said that he didn't see anyone else use the bat during his involvement in the incident but thought that there was someone with a bat also in the vicinity. He is not to my knowledge a doctor or a paramedic so if he didn't see the bat used he would have no reason to believe the guy was anything other than the loser in the fight i.e. he would have no knowledge that the guy had a fractured skull. I've not been involved in too many fights in my life, partly down to being allergic to pain & partly down to being a devout coward. I don't know of anyone who has been involved in a fight attending to the needs of their opponent at the end of it. As jonsnow & Durnford have said already, this case was in the public domain last season & was an incident that occurred prior to Declan signing for Livi; no one was overly concerned that someone accused of such a violent crime was signing so why the furore now? The court found him guilty but there remains the possibility that there has been a miscarriage of justice. So regardless of the verdict & the conviction we still do not know what really happened or whether he is really guilty. If he was still considered a danger to the public he wouldn't have been released. I dare say opposition fans will have a go at him because of the verdict of the original trial, so he is not going to get an easy ride.

His actions when we scored to the Clyde fans was pro-ocotive and we should be fined heavily for his actions. I thought he lacked match sharpness and his delivery of the ball on at least two occasions was dreadful.

Inclined to agree that he didn't have that great a game, and looked very much like a player who was struggling with the effects of missing a large chunk of pre-season
His childish actions towards the Clyde Fans (which is caught on the Livi TV footage) doesn't help his cause any. The level of verbal he will receive is only going to increase as the season goes on and one questions if will be able to fully handle it or if he will react to something a fan or player says to him during a match.

There is not a player in the world that hits the ball perfectly every time anyway so any complaints along these lines is clearly someone wanting to moan because they disagree with his re-signing. Cupping his ears is provocative? Really? I didn't think football supporters were so easily offended. The Clyde fans sounded like they responded with more verbals from the comfort of their seats so I dare say they took it all as good natured wind up...clearly they have a sense of humour.

Honestly, this is almost funny, first of all nothing against Declan, I do not him personally. This is not I repeat, just so it registers, personnel. This is business. No if`s but`s or maybe`s this is business. In my opinion, one person does not make up a team. Football is not an individual sport. The percentage of the potential contribution to us winning or losing with Declan in or out of the side has to be marginal. I am not saying that on previous performance last season that he is not a talented player, but we are not surely that stuck in defence that he becomes the biggest asset to LFC. Now do no not get me wrong, I hope as I have said in a previous post that his case is overturned, we have a miscarriage of justice, Declan gets awarded the millions of pounds for this and we can all live happily ever after. Business is Business and long term future of Livingston Football Club must be a priority attracting new sponsors who will then be associated with a club that has created "headlines" for all the wrong reasons may prove difficult. You could potentially have a business who have excellent reputations not wanting them tarred by supporting sponsoring a club with so many off field activities. Incidentally for those writing above me have you spared a thought for the alleged victim in this? ................. No....thought not!!

We shouldn't have signed him. He shouldn't be in the team. Not after he was found guilty. Not during his appeal. The board have shown a remarkable lack of moral standards in signing him. But hey, they don't pay their debts either so is it any surprise that he's been signed and back in the side? Not really.

Yes I have actually...always thought it strange that the alleged victim lost his job because he was unfit for work...I thought there were laws against that. I suspect it more likely that he lost his job because he was involved in the incident as a protagonist not an innocent bystander. That apart, the fact that Declan is playing for Livi at the moment does not affect the alleged victim in the slightest other than he might be a bit peeved that they guy he thought he had successfully beaten in court is not out on appeal & the decision could in theory be overturned. On your earlier point, I don't think anyone is trying to suggest that Dec is a one man team but the squad is stronger with him than it is without him. Business is business & it appears the board think it is better business to have him in the squad. The bottom line is none of you who are saying we shouldn't have signed him were saying it last season when we signed him in the full knowledge that he had this case to face at some point. The only difference is that he was found guilty of the offence...but oh look, there is now some doubt being cast on that result...so we are essentially back to square one.

The "victim" was on the receiving end of a beating in a fight that from my recollection of the reports, he started. It is quite conceivable that it could have gone the other way. As I mentioned earlier, we knew he was involved in this before he originally signed, no one complained then that a street brawling thug was being signed.

You mean the debt they inherited to pay back a loan that the chairman-at-the-time didn't enforce even though it was in favour of himself? That would be the loan that they want to renegotiate the terms of given they are taking on the responsibility of paying back that debt? Or have they failed to pay other debts already & are we awaiting the arrival of administration again? I'm glad we signed him. I think it takes courage to make a decision that was always going to be divisive; & now that you have taken the moral high ground are you going to own up to every lie you have ever told, every pen you have ever pinched from work etc etc etc He has a court given right to his freedom for the moment, he has a court given right to earn a living at the moment, credit to Livi FC for helping the court in this matter.
